Terms & Conditions

The ‘Terms and Conditions’ listed below represent the basis upon which all driving lessons and driving courses (intensive driving courses or otherwise) are offered to the public by IDC. It should be noted that on booking a driving lesson or an intensive driving course with IDC, all pupils agree to abide by the following terms and conditions and those stipulated on our parent website www.allpassdriving.co.uk. The IDC contract of service is between the pupil concerned and his or her allocated driving instructor.

Cancellation

Intensive Driving Courses – If a pupil cancels his/her intensive driving course (or part thereof) the deposit fee will be refunded minus our cancellation fee of £95 providing that the pupils allocated driving instructor can source alternative work for the period in question. If the allocated driving instructor cannot secure alternative work for the period in question then the deposit fee will be forfeit and non-refundable. A £85 cancellation charge will apply to all intensive driving course cancellations approved. If a pupil cancels their intensive driving course once it has commenced and no alternative work can be sourced for the allocated driving instructor then the driving course fee will be charged in full. Deposit payments are non refundable other than the situations stated above. If a pupil cancels their intensive driving course and requests to keep the practical driving test date booked and paid for by IDC on their behalf the cancellation fee will be £100 plus the practical driving test fee.
Cancellation of a short notice intensive driving course (i.e. where start date is less than 7 days from date of booking), will NOT be possible and full payment of the booked intensive driving course fees will be required. If payment is not paid in full, legal assistance may be sought in order to recover the said intensive driving course fees.

IDC reserve the right to cancel or reschedule a pupils intensive driving course if operational circumstances dictate it necessary to do so. If a pupil cancels a booked driving course before it has been completed it is agreed that IDC are not obliged to pay for that pupils practical driving test and that any test booked will be cancelled unless the pupil reimburses IDC the said test fee amount.

If a pupil decides to cancel their intensive driving course before the said intensive driving course is completed, it is agreed that IDC will NOT pay for the said pupils practical driving test (it will be cancelled unless the pupil reimburses IDC the test fee amount), or refund any monies paid unless otherwise agreed. When it has been agreed that a refund will be offered by IDC to the pupil it is on the understanding and agreement that the discounted intensive driving course fee will no longer apply and that all lessons provided to date will be charged at £27 per hour. However, as an act of goodwill we will gladly discount any future intensive driving course booked by the said pupil within 3 months of them cancelling their original intensive driving course. All driving lessons require 48 hours’ notice of cancellation. If this isn’t provided, then the pupil will be charged for the cancelled lesson.

If the IDC driving instructor deems it necessary to cancel or terminate a pupils driving course because of operational reasons which the pupil will be made aware of, then they will do so and refund the pupil for all outstanding driving lessons not taken.

Failure to comply with our cancellation policy will result in any intensive driving course or driving lesson booked being charged in full. Cancellation requests must be made in writing.

Time Keeping

All pre-agreed driving lessons must commence/finish on times agreed between pupil and driving instructor. If the pupil is late for his/her lesson for any reason, the time will still be chargeable.

If the driving instructor is late, the time will be added on at the end of the lesson or at another time suitable for the pupil. In situations where this isn’t convenient for the pupil, then the time will not be chargeable.

PLEASE NOTE: Your allocated driving may occasionaly be late by 15 – 20 mins for your appontment. Whilst we will always strive to limit this wherever and whenever possible we would like to highlight that sometimes being late is unavoidable due to fluctuations in road traffic; previous pupil delays; road traffic accidents; roadworks and delays caused by a practical driving tests lasting longer than anticipated. Whatever the reason we regard 15 – 20 mins as being within an acceptable ‘lateness threshold’. If your allocated driving instructor is later than this then we will happily reschedule your lesson for another date at no financial loss to you. NB. If you book one of our driving training packages you do so with the knowledge that this can happen and accept our policy above when agreeing to our terms and conditions. If you do not agree please do not book with us.

Intensive Driving Course Information

A non-refundable deposit is to be paid prior to APD booking a prospective pupil onto an intensive driving course. A charge of 3.4% + 0.20 pence will apply to all deposit payments. It should be noted that in addition to the deposit payment, any subsequent tuition fees paid are NOT refundable in the event that a pupil decides to cancel his/her period of driving tuition once the relevant booking has been accepted and agreed by APD and the pupil concerned. An intensive driving courses arrangement fee of £22 will apply to all intensive driving course arranged and booked with IDC.

Before a client/pupil can be enrolled onto an IDC intensive driving course and before a practical test is booked, the client/pupil must complete and submit the Enrolment Form If an intensive course is booked prior to a client/pupil taking their theory test then this form will have to be completed again once the theory test has been passed. No intensive driving course will commence or practical driving test booked until the IDC Enrolment Form is completed.

IDC’s contract is deemed to begin on the day that the pupils intensive driving course and practical test date is booked or date that the pupils deposit is paid, whichever is actioned first.

All intensive driving courses include the time taken to sit the practical driving test (approximately 45minutes).

IDC will pay for the practical driving test of all pupils who enrol onto an IDC intensive driving course only if the pupil agrees to complete all of their training with their allocated IDC driving instructor and sit the the test in the IDC instructors car. In addition, the pupil must provide a ‘pupil feedback’ during the course of their intensive driving course and before their practical driving test. Feedback can be made via our website contact form. If ‘pupil feedback’ is not provided as requested, IDC may decide at their discretion NOT to pay for the said pupils practical driving test. It is agreed by all pupils that ‘pupil feedback’ may be used for marketing purposes by IDC on the internet. We will not advertise pupil addresses, phone numbers or email addresses. In addition, it is agreed by all pupils who enrol onto an IDC intensive driving course that any pupil photographs taken by the pupils allocated driving instructor or provided by the pupil themselves, may be used by IDC for marketing purposes on the internet.

IDC reserve the right to cancel the said intensive driving course and practical driving test if the non-refundable deposit is not paid by the required date, which is within 24 hours of the practical test date being booked.

Once a pupil has made a deposit payment to IDC, they must agree in writing (by email) for their said driving lesson/intensive driving course purchased to be conducted in accordance with the APD terms and conditions. Failure to provide this written confirmation will result in the said pupils driving lesson/intensive driving course being placed on hold until they do so. A £15 booking fee will apply to the any test re-booking by APD.

Normally, all of the training for our Intensive driving courses will be conducted between the hours of 9:00am – 5:00pm (Mon-Fri). Weekend, early morning and evening driving lessons are to be mutually agreed and arranged between the pupil and their allocated IDC driving instructor. If a pupil requires his/her lessons to be conducted on weekends, mornings or evenings, they must give their allocated driving instructors at least 14 days’ notice. The pupils request will then be considered and agreed depending on their allocated IDC driving instructors availability. Where a short notice course is booked/bought, operational availability will determine if evening lessons can be accommodated at the time requested by the said pupil. Where weekend, morning or evening lessons cannot be accommodated due to operational circumstances, the IDC instructor will work with the pupil to determine alternative lesson/practical driving test dates. For all Credit and Debit card deposit payments a 3% handling charge will be applied. I.E. If the required deposit payment is £167, an additional £5.01 handling fee will be applied making the total deposit payment payable £172.01.

The balance of payment must be made in full before an intensive driving course commences. This can be done using (i) Bank Transfer; (ii) Credit Card Payment; (iii) PayPal or (iv) Cash Payment on the first day of a pupils intensive driving course. Please note that an intensive driving courses will not commence until the course fee has been paid in full.

NB. If the balance is paid via PayPal OR Credit Card a 3.0% handling charge will apply without exception.

All pupils will be emailed the following IDC Forms: Pupil Enrolment Form; Pupil/Instructor Receipt Form; Pupil Lesson Record Form. The pupil must print off 2 copies of each form and produce them on their first driving lesson. One copy is for the pupils records and the other copy is for the pupils allocated driving instructors records.

All pupils must complete the IDC Enrolment Form on the first day of their intensive driving course and ensure they receive a receipt for all monies paid to their allocated driving instructor. Furthermore, a copy of the pupil receipt will be provided to their allocated driving instructor. All pupil lessons must be logged at the end of each lesson as being completed by the pupil on the pupil daily record form. If a pupil requests a change of driving instructor at any time after the commencement and during their intensive driving course, the change must be mutually agreed between the pupil and their allocated IDC driving instructor. If the IDC driving instructor cannot source alternative work for the time remaining of the pupils intensive driving course, then the change will be deemed commercially non-viable for the IDC driving instructor and the course fee will be charged in full.

When the situation arises that IDC cannot source their own driving instructor to provide tuition for a particular intensive driving course, it is agreed that IDC will sub-contract the said intensive driving course out to another fully qualified ADI. If such a situation arises, the said intensive driving course will still still be conducted under the IDC Terms and Conditions.

In the event of a driving lesson, intensive driving course or part thereof being cancelled, no penalty will be incurred providing that the IDC instructor can source alternative work for the same training period in question. If this is not possible, the full training fee for the said training period may (at the discretion of the IDC Driving instructor) be charged in full. Therefore, to ensure your IDC instructor can source alternative work, the cancellation of an intensive driving course will only be accepted within 7 working days (not including Saturday, Sunday or Bank Holidays) of an intensive driving course being booked. If less than 7 days’ notice of cancellation is given, the remaining intensive driving course fees MUST be paid in full without exception. If payment is not paid in full, legal assistance will be initiated to recover the said intensive driving course fees for whatever driving course booked. Cancellation of a short notice intensive driving course (i.e. where start date is less than 7 days from date of booking), will NOT be possible and the remaining intensive driving course fees MUST be paid in full without exception. If payment is not paid in full, legal assistance will be initiated to recover the said outstanding intensive driving course fees for whatever driving course booked.

If a pupil decides to cancel their intensive driving course before the said intensive driving course is completed, it is agreed that IDC will NOT refund any monies paid. When it has been agreed that a refund will be offered by IDC to the pupil it is on the understanding and agreement that the discounted intensive driving course fee will no longer apply and that all lessons provided to date will be charged at £29 per hour; however as an act of goodwill we will gladly discount any future intensive driving course booked by the said pupil within 3 months of them cancelling their original intensive driving course. All our driving lessons require 48 hours notice of cancellation. Failure to comply with our cancellation policy will result in any intensive driving course or driving lesson booked being charged in full. Cancellation requests must be made in writing and emailed to our parent company’s (All Pass Driving) email address: info@allpassdriving.co.uk

When a pupil cancels their booked driving test and the money is refunded to IDC, the pupil must re-book and sit their test within 6 weeks of initial test cancellation date. Failure to do so will result in IDC NOT paying for the pupils practical driving test.

If a pupil fails to complete their intensive driving course in full i.e. he/she does not complete the full number of hours of driving tuition booked for their intensive driving course, IDC reserve the right to cancel the said pupils practical driving test without exception. This ruling will also apply if a pupil cancels their driving course unless their allocated driving instructor can source alternative work for the same training period. The pupil will not be entitled to a refund of the DSA test fee for any driving course cancellation.

If a pupil does not respond to any communication made by their allocated ADI, it is agreed that IDC reserve the right to cancel any driving lessons or driving test booked until communication is re-established by the pupil. Once communication has been re-established, the pupils allocated ADI will re-schedule any outstanding driving lessons where possible. Please note that if the pupil concerned has booked an intensive driving course they may not be able to receive all of their remaining lessons if there is insufficient time to do so.

If a pupil is absent without prior agreement with their allocated driving instructor, the absent time will be charged at the normal lesson or intensive driving course pro-rata rates.

It is the sole responsibility of each pupil to check and agree their practical test date and courses details when provided to them by IDC and prior to paying the required deposit. If an error is identified after the deposit payment has been made, any pupil booking driving lessons or an intensive driving course of any descriptions agrees not to hold IDC accountable for any booking error made regarding driving course or practical driving test dates/details. Any such error made regarding driving course or practical driving test dates/details will be deemed as being the sole responsibility of the pupil concerned. Therefore a thorough check of any practical test date and course details provided by IDC must be made by the pupil concerned.

When an intensive driving course is booked and paid in full before the commencement of the said intensive driving course, it is mutually agreed between the pupil and IDC that the training for the said intensive driving course must commence and be completed within 3 months of the payment date. After this 3 month period has elapsed it is agreed that IDC are not obliged to provide training.

When a deposit payment has been paid to IDC for any intensive driving course offered, it is agreed that the driving course must be completed within 3 months of the deposit payment date. If not, it is also agreed that IDC will not pay for the practical driving test for the pupil in question.

Depending on how far a pupils pick up point is from the DSA Test Centre, it is agreed that the last 2-3 hours of each intensive driving course is utilised for: (i) picking the pupil up from there pick up point and driving them to the relevant DSA Test Centre; (ii) time taken for the pupil to sit their practical driving test and (iii) dropping the pupil off at their agreed drop off point once the practical test has finished.

Failure to comply with our cancellation policy will result in any intensive driving course or driving lesson booked being charged in full. Date of booking is effective from the date the pupils practical driving test is booked/deposit is paid to IDC.

NB. Please ensure you know what an intensive driving course consists of before purchasing one of our courses. Intensive driving courses are an excellent way to learn to drive for some individuals, but others can find them overwhelming. Finding that the course you have purchased is difficult is not a reason to cancel.

Payment

A non-refundable deposit must be paid in advance of any intensive driving course taking place. The remainder of the course fee can be paid by either (i) bank transfer at least 7 days prior to the intensive driving course commencement date; (ii) cash payment at the commencement of the said intensive driving course i.e. the first day of the driving course.

Practical Test Booking

(i)IDC will book and pay for a pupils practical driving test using DSA weekday (MON – FRI) test fee rates ONLY. It is a condition of booking an intensive driving course with IDC that: 1. Weekend practical test fee supplement charges/rates must be paid by the pupil concerned; 2. The pupil provides a Google review, likes IDC on Facebook and leaves a comment in addition to providing feedback via the IDC website.

(ii) When the situation arises that a pupil books and pays for their own practical driving test, IDC will refund the practical driving test fee ONLY after the said pupil has completed their intensive driving course and taken their practical driving test. It’s a requirement that the practical driving test is taken before the practical driving test fee will be refunded to the said pupil. If the pupil fails to complete their intensive driving course with IDC or fails to take their practical driving test in an allocated IDC instructors car (unless otherwise agreed) for any reason whatsoever, their practical driving test fee will NOT be refunded by IDC. No course completion/practical driving test taken = No refund!

(iii) The management of a pupils practical test booking is solely the responsibility of the pupil. To check, change or cancel a practical driving test date, visit the following website: www.gov.uk/change-date-practical-driving-test

(iv) When a pupil changes a practical test date, the following email address must be inserted into the relevant DSA form: info@allpassdriving.co.uk (our parent company email address).

(v) If a pupil changes their practical driving test date without informing IDC in writing, then APD reserve the right to change again the said pupils practical driving test date to a date and time suitable for the said pupils allocated driving instructor OR other available driving instructor. Therefore, to avoid any upset or distress, any pupil wanting a change of practical driving test date must seek approval from IDC both verbally and in writing before any date change is implemented.

(vi) If a pupil changes their practical driving test date without IDC approval and the new date is less than 4 clear working days away from the date the test date change was implemented, IDC will not refund any fees in the event that they cannot source an IDC for the new practical test date or period of training.

(vii) If a pupil books an intensive driving course and then cancels their course within 28 days of the course start, the full course fee will still be required to be paid to IDC.

(viii) When a pupil books their own practical test date, IDC cannot and will not be held responsible if a pupil provides their allocated driving instructor with the incorrect test date and/or time. In the event a pupil provides their allocated driving instructor with an incorrect test date/time, IDC waive all responsibility. All practical driving test payment refunds must be invoiced by pupil. An admin fee of £15 will be charged for all practical driving tests booked, changed or cancelled by IDC.

IDC Vehicle

In the interests of customer, public and DSA staff safety, your ‘IDC’ instructor reserves the right to withhold the use of their tuition vehicle for the practical driving test if, in their opinion, your driving is actually or potentially dangerous. The practical driving test fee (currently £62) will be forfeited if your practical test is cancelled within three working days of the said test.

Test Cancellation

Four clear working days’ notice of cancellation or postponement is required by the DSA. Failure to provide the required notice will result in the loss of your test fee. Your IDC instructor cannot be held responsible for any postponement or cancellation of tests by the DSA. However, he or she will do all that is possible to arrange another test as quickly as possible and to help you to reclaim expenses from the DSA.

IDC reserve the right to cancel or reschedule a pupils intensive driving course if operational circumstances dictate it necessary to do so.

Adverse Weather Conditions

Your IDC instructor reserves the right to postpone or cancel any lesson if he/she feels that the weather or road conditions are unsuitable or dangerous for the proposed driving lesson to be conducted. Your IDC instructor will re-schedule any lessons cancelled because of adverse weather conditions for another date and time suitable to both parties, at no additional cost to the pupil.

Your IDC instructor cannot be held responsible for costs incurred by the pupil should he/she have to postpone any lessons, for whatever reasons.

Complaints Procedure

In the even that any IDC pupil has a complaint about any aspect of their driving tuition, the pupil must make their complaint in the first instance to the relevant IDC driving instructor. If after doing so the pupil feels that the complaint has not been resolved satisfactorily, then they should make their complaint in writing using the following email address: info@allpassdriving.co.uk. Your Statutory Rights

Nothing in the above mentioned Terms and Conditions will affect your statutory rights relating to mis-described or faulty goods or services provided by IDC. It is a statutory requirement and obligation of all IDC driving instructors to provide all of our pupils with goods and services fit for the purpose for which they were bought and as described. If you have any doubts whatsoever about your statutory rights, please contact your local Trading Standards Department or Citizen’s Advice Bureau.
